Terms and Conditions for Booking Stays through SVOYAGER

These Terms and Conditions govern the booking of accommodation through the SVOYAGER website, app or other digital interface.
Please read these Terms carefully before making a booking. By making a booking through SVOYAGER, you confirm that you have read, understood and accept these Terms, together with the applicable cancellation rules, rate conditions, Privacy Policy and Cookie Policy.
1. Definitions
SVOYAGER, we, us, our means SVOYAGER CONCIERGE & CONSULTANCY - FZCO, a company registered in the IFZA free zone (International Free Zone Authority), Dubai, United Arab Emirates (IFZA license № 79681, premises 79681-001; registered office: IFZA Business Park, Building A1, Dubai Digital Park, Dubai Silicon Oasis, P.O. Box 342001, Dubai, UAE), trading under the SVOYAGER brand.
SVOYAGER Platform means the svoyager.com website, the mobile or web interfaces, the booking pages, the user account, the Trips section, the payment interface, customer support and other SVOYAGER digital tools through which a user can search, compare, save and book accommodation.
Website means svoyager.com and any of its subdomains, pages or related digital interfaces used to book accommodation.
Terms means these Terms and Conditions for booking accommodation, together with the applicable rate conditions, cancellation rules, Privacy Policy, Cookie Policy and other documents referenced during the booking process.
You, your, user, guest means the person who uses the SVOYAGER Platform, makes a booking or is named as a traveller in the booking confirmation.
Lead booker means the person who makes the booking, provides the payment details and acts as the main point of contact for the booking.
Travellers means all persons named in the booking, including the lead booker, guests, children, additional guests and any subsequent replacements or additions, where permitted by the booking conditions.
Accommodation means a hotel, aparthotel, serviced apartment, holiday home, villa, apartment, room or other accommodation available to book through SVOYAGER.
Accommodation Provider means the hotel, management company, serviced apartment operator, holiday home operator, property manager, owner of the accommodation or other third-party provider that actually provides the stay to the guest.
Booking Partner means a third-party provider of inventory, booking, payment processing or booking confirmation through which SVOYAGER may access rates, availability, cancellation rules and booking confirmation. For certain bookings this partner may be Nuitée.
Nuitée means Nuitée Travel Limited, a company registered in Ireland with registered office at 4 Waterloo Rd, Ballsbridge, Dublin, D04 A0X3, Ireland. Depending on the specific booking, Nuitée may act as a third-party booking partner, payment processor, booking confirmation provider or merchant of record.
Payment Provider means a bank, payment gateway, acquirer, card network, payment intermediary or other regulated payment organisation that processes a payment, refund, authorisation, chargeback or settlement.
Booking confirmation means the electronic confirmation, voucher, booking confirmation, receipt, itinerary or other document that confirms the details of your booking.
Unavoidable and extraordinary circumstances means circumstances beyond the reasonable control of the parties, the consequences of which could not have been avoided even if all reasonable measures had been taken. These may include, among others, war or threat of war, riots, civil unrest, terrorist activity, industrial disputes, strikes, natural disasters, fires, epidemics, pandemics, serious health risks, extreme weather, decisions of public authorities, border closures, travel restrictions, and disruptions to payment systems, transport infrastructure, suppliers or booking systems.
2. Role of SVOYAGER, Nuitée and the Accommodation Provider
SVOYAGER is an online platform, a technology interface and an intermediary through which users can search, compare, save and book accommodation.
SVOYAGER is not a hotel, an owner of the accommodation, a hotel operator, a management company, a transport operator or the actual provider of the stay.
The actual stay is provided by the relevant Accommodation Provider. The Accommodation Provider is responsible for the property, the availability of the stay, check-in, accommodating guests, the condition of the property, compliance with local requirements, the safety of the property, on-site service and other services actually provided to the guest.
For certain bookings SVOYAGER may use third-party Booking Partners, including Nuitée. In such cases the rates, availability, cancellation rules, booking confirmation, payment processing, refunds or supplier-side support may be handled, in whole or in part, by the relevant Booking Partner.
If a booking is processed through Nuitée or another Booking Partner, this does not make SVOYAGER the actual provider of the stay. SVOYAGER remains the platform, the interface and, where applicable, the first line of support for the user.
Additional terms of the Booking Partner, the Accommodation Provider or the Payment Provider may apply during the booking process or in the booking confirmation. Such terms apply to the relevant part of the booking, including the rate, payment, cancellation, refund, change, no-show, check-in and stay.
Which model applies to your specific booking — a booking made directly through SVOYAGER, through a Booking Partner (for example, Nuitée) or by continuing the booking on a third-party provider's website — is shown during the booking process and/or in the booking confirmation.
3. Contact us
For questions about bookings, changes, cancellations, payments, vouchers, support or complaints, you can contact SVOYAGER through the contact details shown on the SVOYAGER Platform, in your booking confirmation, or at:

If your booking confirmation lists a separate contact for emergency support, on-site support, Booking Partner support or Accommodation Provider support, you may also use that contact.
In the event of an urgent problem during your stay — including being refused check-in, the property being unable to find your booking, a material discrepancy with the property, being unable to access the property, or a safety threat — you should contact SVOYAGER as soon as possible and at the same time report the problem to the Accommodation Provider on site.
3.1. Additional support for bookings processed through Nuitée
If your accommodation booking is processed through Nuitée, or if your booking confirmation states that Nuitée is the Booking Partner, payment processor or support provider, you may also use the following Nuitée contacts:

These contacts apply only to bookings processed through Nuitée and do not apply to SVOYAGER Partner Stays or other bookings unless Nuitée is named in the booking confirmation.
3.2. Urgent Nuitée support before check-in or during your stay
For urgent matters related to check-in or your stay, if the booking is processed through Nuitée and the problem arises within 7 days before the check-in date or while the guest is at the destination, the following contacts may be used:

Please note that Nuitée's 24/7 destination support is available only while the guest is at the destination.
The Nuitée contacts above are current as of the date of publication of these Terms and may change; the source of truth for the current contacts for your booking is your booking confirmation.
3.3. Order of contact
If you are not sure which contact to use, contact SVOYAGER first. We will try to identify the type of booking and, if necessary, direct you to the Booking Partner, the Accommodation Provider or the appropriate emergency support channel.
4. Agreement
Before booking, you should carefully review these Terms, the cancellation rules, the rate conditions, the property description, the payment information, and information about taxes, fees and possible on-site charges.
By making a booking through SVOYAGER, you confirm that you:
1. accept these Terms;
2. accept the applicable cancellation rules and rate conditions;
3. accept the Privacy Policy and the Cookie Policy;
4. understand SVOYAGER's role as a platform and intermediary;
5. understand that the actual stay is provided by the Accommodation Provider;
6. understand that certain bookings may be processed through Nuitée or another Booking Partner.
If you do not agree with these Terms, you should not proceed with the booking.
5. Non-package travel
Unless expressly stated otherwise, booking accommodation through SVOYAGER is not a package holiday, a package tour, a linked travel arrangement or an organised tour.
SVOYAGER does not sell you a package holiday as a tour operator. SVOYAGER provides a digital platform and the booking of individual accommodation services that are provided by independent third parties.
If other travel-related services — such as transport, activities, insurance, visa support or other services — are offered on the SVOYAGER Platform in the future, they will be governed by separate terms or by the terms of the relevant providers.
This document governs the booking of accommodation specifically, unless expressly stated otherwise.
6. Booking confirmation
To make a booking, you confirm that:
1. you are at least 18 years old;
2. you have the right to enter into legally binding agreements;
3. you have the consent of all persons named in the booking;
4. you have the consent of the parents or legal guardians of minor travellers, where applicable;
5. all travellers are aware of the applicable booking conditions;
6. all the data you enter during the booking process is complete and accurate;
7. you are responsible for the accuracy of names, dates, number of guests, contact details, nationality, special requests and other information required for the booking;
8. you are responsible for paying for the booking, including cancellation, change and no-show fees, local charges, deposits and other applicable payments.
A booking is considered made only after the payment process has been completed successfully, confirmation has been received from the booking system or the Booking Partner, and a booking confirmation has been sent to you.
The display of a property, price or availability on the SVOYAGER Platform before final confirmation is not a guarantee of a booking.
7. Booking through SVOYAGER
To make a booking, you select the destination, the check-in and check-out dates, the number of guests, the number of rooms, the type of accommodation, the rate and other parameters.
During the booking process SVOYAGER may request your personal data, including first name, last name, email, phone number, country of residence, guest details, special requests, payment information and other data required to complete the booking.
Before the booking is completed, you will be shown the available information about: the property; the stay dates; the room or property type; the number of guests; the price; taxes and fees, where available; possible local charges or on-site payments; the cancellation rules; the rate conditions; important property information; the payment information; and the applicable booking conditions.
By clicking the booking or payment button, you confirm that you wish to make the booking and, where applicable, authorise the charge or authorisation of the payment.
If you notice an error in the details before confirming the booking, you must correct it before completing the booking. If an error is discovered after confirmation, you must contact SVOYAGER immediately. Correcting an error after confirmation is not always possible and may depend on the rate conditions, the Booking Partner or the Accommodation Provider.
After the booking is confirmed, you will receive a booking confirmation, a voucher or access to the booking details in your SVOYAGER account, where this feature is available.
SVOYAGER may display the booking confirmation, voucher, trip details, check-in details, cancellation status and support updates in the Trips section or another user section.
8. Personal data and privacy
SVOYAGER processes your personal data in accordance with our Privacy Policy.
To process the booking, your personal data may be shared with: the Accommodation Provider; the Booking Partner, including Nuitée, where applicable; the Payment Provider; technical infrastructure providers; support services; providers of fraud prevention, compliance, security and dispute management; public authorities, where such disclosure is required by law; and other parties where necessary to fulfil the booking, protect rights, prevent fraud or meet legal obligations.
Such data may include first name, last name, contact details, booking details, guest details, payment status, cancellation or change data, correspondence with support and other information required to process the booking.
If the booking is processed through Nuitée or another Booking Partner, that partner may independently process part of the data in accordance with its own privacy rules and applicable law.
Your data may be processed and transferred outside your country of residence where this is necessary to process the booking, the payment, support or to meet legal obligations.
By proceeding with the booking, you confirm that you understand that such data transfer is necessary to make and fulfil the booking.
9. Booking price
The booking price is shown during the booking process before payment. The price may include the cost of the stay, applicable taxes, fees, service charges, commission, margin or other payments, where these are applicable and shown during the booking process.
The stated price may not include certain local charges, taxes or payments that are paid directly to the Accommodation Provider or to local authorities on site. These may include: tourist tax; city tax; resort fee; tourism dirham; accommodation deposit; damage deposit; charges for additional services; extra bed charges; early check-in or late check-out charges; parking charges; pet charges, where allowed; and other local fees.
SVOYAGER will endeavour to show the available information about such charges before payment, where this information is provided by the Accommodation Provider or the Booking Partner. However, some charges may be set or changed by the Accommodation Provider, local authorities or third parties.
Charges from your bank, card issuer, payment system, currency conversion or international transaction are not included in the booking price and are paid by you separately.
10. Changes to price, availability and obvious errors
Prices and availability may change until the booking is finally confirmed.
Before the booking is completed, SVOYAGER, the Booking Partner or the Accommodation Provider may re-check the price, availability, cancellation rules and rate conditions.
If the price, availability or rate conditions have changed before confirmation, you may be asked to accept the updated terms or to decline to proceed with the booking.
After the booking is confirmed, the price is considered confirmed, provided you do not change the booking and the booking does not contain an obvious error.
SVOYAGER is not responsible for obvious errors, technical failures, typographical errors, supplier errors, incorrect rates, incorrect availability, or the incorrect display of taxes or fees, where such errors are obvious or arise from data provided by third parties.
If an obvious error in the price, availability or terms is discovered after booking, SVOYAGER or the Booking Partner may contact you and offer to: confirm the booking at the correct price or terms; choose alternative accommodation, where available; or cancel the booking with a refund of the amount paid, if payment has already been made.
11. Minors and children
The conditions for accommodating children, children's rates, extra bed, baby cot, the maximum room capacity and other rules are determined by the Accommodation Provider.
If you travel with children or minors, you must state the correct number of guests and the ages of children, where this information is requested.
If you require a baby cot, an extra bed, connecting rooms or other special arrangements, you must state this when booking. Such requests are not guaranteed unless expressly confirmed by the Accommodation Provider.
Some properties may have age restrictions, rules for minor guests, or requirements to be accompanied by an adult guest.
12. Additional guests and booking for another person
If you make a booking for another person, you confirm that you have the right to share their data and to accept the booking conditions on their behalf.
The Accommodation Provider may refuse check-in if the guest's name at check-in does not match the name in the booking confirmation, unless a change or addition of a guest has been arranged in advance.
Additional guests, third parties, extra beds or a change in the composition of guests may incur additional charges and depend on the Accommodation Provider's rules.
The accommodation may be used only by the persons named in the booking confirmation, unless otherwise permitted by the Accommodation Provider.
13. Booking payment
During the booking, the full booking amount, a partial amount, a deposit or another payment shown during the booking process may be charged to or authorised on your card or selected payment method.
The payment may be processed by: SVOYAGER through an approved Payment Provider; Nuitée or another Booking Partner; the Accommodation Provider; or another Payment Provider shown during the booking process.
For certain accommodation bookings processed through a Booking Partner, in particular through Nuitée, that partner may act as a payment processing and booking processing partner, and in certain cases as merchant of record. In that case, the bank statement, card statement or payment confirmation may show Nuitée, SVOYAGER, the Payment Provider or another payment descriptor specified during payment or in the confirmation.
SVOYAGER may display or send you a booking confirmation, voucher or booking details based on data received from the Booking Partner or the Accommodation Provider.
Payment methods may include bank cards, Apple Pay, Google Pay or other methods, where available in the specific country, currency and payment flow. The availability of payment methods is not guaranteed and may depend on the Payment Provider.
SVOYAGER does not store your full card number where payment processing is handled by a third-party Payment Provider.
You confirm that you use the payment method lawfully, that you are authorised to use it, and that you authorise the payment, authorisation, refund or additional verification where required for the booking.
If a payment fails, is declined, is deemed suspicious, is cancelled by the bank or is not confirmed by the Payment Provider, the booking may not be made or may be cancelled.
14. Booking changes
All booking changes are subject to availability, the rate rules, the Accommodation Provider, the Booking Partner and the applicable booking conditions.
A change request may include changing the dates, the number of guests, a guest's name, the room type, special requests or other booking parameters.
Changes are not guaranteed. Some rates do not allow changes. Some changes may be treated as a cancellation of the current booking and the making of a new booking.
If a change is possible, you may be charged the difference in price, an administrative fee, a penalty from the Accommodation Provider, a Booking Partner fee or other applicable payments.
All change requests must be made through SVOYAGER or the indicated support channel. You should not make changes directly with the Accommodation Provider unless you have been expressly told to do so.
Urgent changes, especially within 72 hours before check-in, must be made as quickly as possible through SVOYAGER support. SVOYAGER does not guarantee that an urgent change will be possible.
If the Accommodation Provider, Nuitée or another Booking Partner changes or cancels a material part of your booking, SVOYAGER will try to notify you and, where possible, offer available options: to accept a new condition or alternative accommodation; to accept lower-grade accommodation with a corresponding price adjustment, where applicable; or to cancel the booking with a refund in accordance with the applicable rules.
15. Cancellation by the user
Cancellation rules depend on the specific rate, the Accommodation Provider and the Booking Partner. They are shown during the booking process and/or in the booking confirmation.
Before payment, you must carefully check the cancellation rules. Some bookings may be fully non-refundable. For other bookings, free cancellation may be available until a certain date and time.
All cancellations must be made through SVOYAGER, the booking section, the link in the booking confirmation or support, unless another procedure is stated in the confirmation.
Cancellation made directly with the Accommodation Provider may not be considered valid if the applicable terms require cancellation through SVOYAGER, Nuitée or another Booking Partner.
Cancellation deadlines may be calculated in the time zone stated in the cancellation rules. If no time zone is stated, UTC / GMT or another time zone used by the Booking Partner may apply.
If you cancel a booking, the refund will be calculated in accordance with the applicable cancellation rules. The cancellation fee may be up to 100% of the booking value.
If a cancellation cannot be made through the SVOYAGER interface, you must send a written request to SVOYAGER support stating the booking number, the lead booker's name, the property and the stay dates.
A refund, where applicable, is usually made to the original payment method. The time for funds to arrive may depend on the Payment Provider, the bank, the card network and the country where the card was issued.
If you leave the property earlier than the check-out date, a refund for unused nights is not guaranteed. Such a refund depends on the rate conditions, the decision of the Accommodation Provider and the Booking Partner. A written confirmation from the Accommodation Provider stating the actual date and time of departure may be required to consider such a request.
16. Cancellation by SVOYAGER, a partner or a provider
In rare cases, a booking may be cancelled by SVOYAGER, Nuitée, another Booking Partner or the Accommodation Provider due to unavailability of the property, a rate error, a booking error, a technical failure, a payment failure, suspected fraud, sanctions restrictions, the inability to provide the service or other reasons.
If a booking is cancelled through no fault of yours and not due to Unavoidable and extraordinary circumstances, SVOYAGER will try to facilitate one of the following options: a full refund of the amount paid, if payment was made; alternative accommodation of a similar or higher grade, where available; or lower-grade alternative accommodation with a corresponding price adjustment, where applicable.
The availability of alternative accommodation is not guaranteed.
If the cancellation is caused by Unavoidable and extraordinary circumstances, the rate conditions, the Accommodation Provider's rules, the Booking Partner's rules and applicable law apply.
17. No-show
If you do not arrive at the property on the check-in date and do not cancel the booking in accordance with the cancellation rules, this may be treated as a no-show.
In the event of a no-show, you may lose the right to a refund, including the right to a refund for all nights of the booking.
The Accommodation Provider may cancel the remainder of the booking if you have not arrived by the set time and have not notified the property or support in advance.
If you expect a late check-in, you must contact SVOYAGER and/or the Accommodation Provider in advance. A late check-in is not guaranteed unless confirmed by the property.
18. Insurance
SVOYAGER strongly recommends taking out suitable travel insurance before your trip.
Insurance may cover medical expenses, trip cancellation, delays, lost luggage, accidents, early departure, inability to check in and other risks.
Unless insurance has been purchased through SVOYAGER or is expressly included in your booking, SVOYAGER does not provide insurance cover.
You are solely responsible for choosing and holding suitable insurance.
19. Unavoidable and extraordinary circumstances
SVOYAGER is not responsible for delays, changes, cancellations, inability to check in, losses, expenses or damage caused by Unavoidable and extraordinary circumstances.
These may include decisions of public authorities, travel restrictions, wars, security threats, terrorist events, natural disasters, fires, epidemics, pandemics, severe weather, border closures, strikes, disruptions to transport infrastructure, disruptions to payment systems, communications outages, supplier system failures, supplier insolvency or other events beyond SVOYAGER's reasonable control.
In such cases, refunds, changes and alternatives will depend on the rate conditions, the decision of the Accommodation Provider, the Booking Partner, the Payment Provider and applicable law.
20. Complaints and problems during your stay
If a problem arises during your stay, you must report it immediately to the Accommodation Provider on site and to SVOYAGER.
This is important because many problems can be resolved only during your stay, not after check-out.
These problems may include: the property cannot find the booking; refusal of check-in; a material discrepancy with the room or property; cleanliness or safety problems; inability to access the property; the absence of advertised key amenities; a dispute over a deposit or local charges; and other material problems.
You must provide SVOYAGER with reasonable evidence of the problem, where available: photos, videos, written confirmation from the property, the name of a property staff member, the time of contact, copies of messages or receipts.
SVOYAGER will try to help with communication with the Accommodation Provider, Nuitée or another Booking Partner. However, SVOYAGER does not guarantee a particular outcome where the resolution depends on the Accommodation Provider, the Booking Partner or the rate conditions.
If the problem is not reported in good time during your stay, the possibility of a refund or compensation may be limited.
21. Personal injury, damage and liability
SVOYAGER is not the owner, operator or manager of the property and does not control the day-to-day operations of the Accommodation Provider.
SVOYAGER is not responsible for injury, illness, death, property damage, loss of belongings, inconvenience, moral harm, expenses or losses caused by acts, omissions, negligence, breach of rules or the condition of the property, where such circumstances are beyond SVOYAGER's reasonable control and relate to the actual provision of the stay by the Accommodation Provider.
If an injury, illness or material incident occurs during your stay, you must: contact the Accommodation Provider immediately; contact the local emergency services if necessary; notify SVOYAGER as soon as possible; provide available documents, photos, medical certificates, reports or confirmations; and cooperate with SVOYAGER, the Accommodation Provider, the Booking Partner, insurers or the competent authorities in investigating the incident.
To the maximum extent permitted by applicable law, SVOYAGER's liability for any booking is limited to the amount actually paid by you for the relevant booking through SVOYAGER.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
22. Guest conduct
You and all travellers must behave reasonably, respectfully and safely.
SVOYAGER, the Accommodation Provider or the Booking Partner may refuse service, cancel a booking or stop support if your conduct or the conduct of other travellers is: aggressive; threatening; abusive; unlawful; fraudulent; dangerous; in breach of the property's rules; causing damage to property; or creating a risk to other guests, staff, suppliers or SVOYAGER.
You are responsible for any damage caused by you or other travellers to the property, the Accommodation Provider's property, common areas, furniture, equipment or third parties.
The Accommodation Provider may require payment for damage, a deposit or a hold on funds in accordance with its rules.
23. Currency conversion and bank charges
Prices may be displayed in different currencies depending on the user's settings, country, payment method, the Booking Partner or the Payment Provider.
Exchange rates may be approximate and may differ from the rate of your bank, payment system or card issuer.
Your bank, card issuer or payment system may charge fees for an international transaction, currency conversion, cash advance, cross-border payment or other operations.
SVOYAGER is not responsible for such fees where they are charged by your bank, payment system or card issuer.
If a refund is made in a different currency or through a different payment system, the refund amount in your local currency may differ due to changes in exchange rates or bank fees.
24. Promo codes, discounts and promotions
SVOYAGER may provide promo codes, discounts, referral credits, partner offers or other promotions.
A promo code may be used only in accordance with the terms of the specific promotion. It may be limited by validity period, country, currency, property type, minimum amount, number of uses, user or other parameters.
A promo code must be applied before the booking is completed. If a promo code is not applied before payment, it does not apply retroactively, unless SVOYAGER expressly agrees otherwise.
SVOYAGER may cancel, refuse to apply or withdraw a promo code if there are grounds to believe it is being used improperly, fraudulently, unlawfully or in breach of the promotion's terms.
If a booking is cancelled, a used promo code may not be restored, unless otherwise stated in the promotion's terms.
25. Travel restrictions, sanctions and prohibited destinations
You are solely responsible for complying with applicable laws, sanctions, visa requirements, immigration rules, travel restrictions, entry rules, exit rules and other requirements of the country of departure, transit and destination.
Some destinations, providers, nationalities, payment methods or bookings may be restricted due to sanctions, payment-system requirements, legislation, or the policy of the Accommodation Provider or the Booking Partner.
SVOYAGER, the Booking Partner, the Payment Provider or the Accommodation Provider may refuse a booking, cancel a booking or block a payment if the booking breaches applicable sanctions, restrictions, compliance rules or security requirements.
If you are a citizen, resident or person subject to special restrictions of a particular country, you are responsible for checking yourself whether travel, booking and payment for the relevant services are permitted to you.
SVOYAGER is not responsible if you cannot travel due to sanctions, visa restrictions, immigration requirements, refusal of entry, lack of permits, breach of entry rules or non-compliance with the requirements of public authorities.
26. Fraud, security and unlawful activity
Payment must be authorised by the lawful holder of the payment method.
SVOYAGER, the Booking Partner or the Payment Provider may carry out security checks, fraud prevention, identity verification, payment risk review, sanctions screening and other checks.
SVOYAGER reserves the right to refuse a booking, cancel a booking, block an account, suspend support or pass information to the competent persons if there are grounds to believe that: the payment is not authorised; the booking is fraudulent; the card is being used without the holder's permission; the user's data is inaccurate; the user is trying to circumvent the rate rules; the booking is connected with unlawful activity; there is a risk of chargeback, fraud, abuse or breach of sanctions; or the user is in breach of these Terms.
If a bank, card issuer, payment system or competent authority requests information about a disputed or suspicious transaction, you agree that SVOYAGER may pass on the necessary information to the extent permitted by law and the Privacy Policy.
If a booking is cancelled due to fraud, an unauthorised payment or unlawful activity, a refund may be refused or delayed until the verification is complete.
27. Passport, visa, immigration and health requirements
You are solely responsible for holding a valid passport, visa, entry permit, transit visa, medical documents, insurance, vaccinations, tests, travel authorisation, residence permit or other documents required for your trip.
SVOYAGER is not responsible if you cannot travel, check in, complete registration, cross a border or use a booking due to missing documents, refusal of entry, passport expiry, visa refusal, medical requirements, sanctions or other requirements of public authorities.
You must check the current requirements before booking and again before travelling, as requirements may change.
If you cannot use a booking due to non-compliance with such requirements, the standard cancellation and no-show rules of the relevant booking apply.
28. Communications with you
SVOYAGER may contact you by email, phone, SMS, WhatsApp, push notification, in-app message or another channel that you have provided or chosen.
We will assume that the contact details you have provided are correct. You are responsible for updating your email, phone number and other contact details in good time.
SVOYAGER may send you: the booking confirmation; the voucher; payment information; trip reminders; information about changes; information about cancellation; support updates; check-in details; requests for additional data; security or fraud-prevention messages; and legal or service notices.
If you do not receive messages due to an incorrect email, mail blocking, spam filters, disabled notifications or an unavailable phone, SVOYAGER is not responsible for the consequences, provided the message was sent to the contact details you provided.
29. Assignment of rights and obligations
SVOYAGER may transfer, assign or delegate, in whole or in part, its rights and obligations under these Terms to an affiliated company, a successor, a service provider, a Payment Provider, a Booking Partner or another party, where this is necessary to fulfil a booking, operate the platform, for corporate restructuring, a sale of the business, technical processing or to meet legal obligations.
You may not transfer your rights or obligations under these Terms to third parties without the prior written consent of SVOYAGER, unless such transfer is permitted by applicable law or the terms of the specific booking.
30. Order of precedence
If there are differences between these Terms, the rate conditions, the cancellation rules, the booking confirmation, the Accommodation Provider's terms or the Booking Partner's terms, the following rules apply:
1. the special rate conditions and cancellation rules of the specific booking take precedence in relation to cancellation, change, no-show and refund;
2. the Booking Partner's terms may apply to payment processing, confirmation, refunds, chargebacks, supplier-side support and other elements that such partner actually handles;
3. the Accommodation Provider's terms apply to check-in, the stay, property rules, deposits, guest conduct, local charges and on-site services;
4. these Terms apply to the use of the SVOYAGER Platform, SVOYAGER's role, support, communications, data, general booking rules and the relationship between you and SVOYAGER.
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions remain in force.
31. Changes to these Terms
SVOYAGER may update these Terms from time to time.
The version of the Terms in force at the time of your booking applies to that booking, unless otherwise required by law or related to an update for reasons of security, compliance, payment rules or supplier requirements.
By continuing to use the SVOYAGER Platform after the Terms are updated, you accept the updated version of the Terms for future bookings.
32. Governing law and jurisdiction
These Terms, as regards the relationship between you and SVOYAGER, are governed by the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai, unless otherwise required by the mandatory rules of applicable consumer law.
Disputes related to the use of the SVOYAGER Platform or the relationship between you and SVOYAGER are subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates, unless otherwise required by the mandatory rules of applicable law.
If a specific booking is processed through Nuitée, another Booking Partner, a Payment Provider or the Accommodation Provider, their own terms may provide for separate governing law and jurisdiction in respect of the part of the service that they provide.
Nothing in these Terms limits the mandatory consumer rights that cannot be excluded under applicable law.
33. Final provisions
These Terms constitute the agreement between you and SVOYAGER regarding the use of the SVOYAGER Platform to book accommodation.
By making a booking, you confirm that you understand: SVOYAGER is a platform and intermediary; the actual stay is provided by the Accommodation Provider; certain bookings may be processed through Nuitée or another Booking Partner; the payment descriptor may differ from the SVOYAGER brand; the cancellation, change and refund rules depend on the specific rate; local charges, deposits and additional services may be paid on site; and you are responsible for the accuracy of data, your travel documents and compliance with the property's rules.
Governing language. These Terms may be published in several languages for the convenience of users. The English-language version prevails. In the event of any discrepancy, conflict or ambiguity between the English version and a translation into any other language, the English version applies, unless otherwise expressly required by the mandatory rules of applicable law.
No waiver. If SVOYAGER does not exercise or enforce any right or provision of these Terms, this is not a waiver of that right or provision and does not deprive SVOYAGER of the right to exercise it later. Any waiver is effective only if made in writing.
